GENERAL

The listed terms and conditions will apply to the sale and supply of medical equipment and associated services by Western Equipment Supplies Ltd hereby referred to as WES, to the entity hereby referred to as 'The Customer'.

RETENTION OF TITLE / OWNERSHIP

Legal ownership of any goods supplied will remain vested to WES, until such time that full payment of order/invoice monies has been received in connection with the sale. Should the the Customer obtain goods prior to full order payment, The Customer accepts that WES retains the right to demand and receive immediate settlement of outstanding monies prior to transfer of ownership, or the the Customer grants WES unrestricted access to reclaim the goods, at which point an order cancellation process shall be instigated. The saleable condition of the goods prior to any reclaim is sole the responsibility of the Customer.

PRICES

All pricing as shown upon our sales literature and this web site are shown in (£) Pounds Sterling, exclusive of the current prevailing rate of Value Added Tax (VAT). 'The Company' VAT number is 609790119. All goods shall be supplied with a delivery charge when delivered to addresses in mainland England, Wales, Scotland and Europe. Delivery Charges will be charged accordingly.

PAYMENT

Payments are only accepted in (£) Pounds Sterling by the following means; cash, cheque (made payable to Western Equipment Supplies Ltd), Visa, MasterCard, Switch or Delta. Where payments are made using a 'card' based method, it should be noted that any goods purchased by this method can only be delivered to the cardholders registered address, unless the Customer provides due authorization to the contrary. WES standard payment terms are; full payment with order; cleared prior to delivery. WES reserves the right to alter the standard payment terms of any customer if deemed appropriate, or where special terms form part of a package deal or offer.  

DELIVERY

Any product ordered will be delivered at the earliest possible opportunity, subject to the order value having been fully paid (and cleared), either using our own transport or direct from the manufacturer. Any delivery dates or period given in good faith by WES are for indication purposes only. The usual delivery period from date of order is 14-28 days, however this could extend during peak ordering periods. As WES is not the manufacturer, it cannot be held responsible for delays in the delivery caused by the manufacturing process or by a third party such as a contracted carrier. Should the delivery period extend beyond the delivery indication given, The Customer has the right if so desired to cancel their order and request a full refund of monies paid. All delivered goods have to be signed for by the the Customer' or their appointed representative, at which point the responsibility and risk of the goods (not title if unpaid) shall pass to the Customer.

SHORTAGES / DAMAGE

The Customer shall inspect the goods and notify WES within seven days of the day of receipt of any shortages or damage to the said goods. WES will advise the manufacturer of any reported shortage/damage and request that the affected component be repaired or replaced at the manufacturers discretion. If notification is not forthcoming from the Customer within seven days or if the damage has occurred while on the Customer's property or during their own installation, we reserve the right to accept the manufacturers findings and either charge for or decline to rectify any fault.

RETURN PROCEDURE

All goods supplied are manufactured to match the specifications shown within our product literature. If however the goods are considered so faulty within seven days after the delivery date, that a full replacement is required, we will arrange with the manufacturer to collect the goods and supply a merchantable replacement or offer a full refund after collection if appropriate. If the goods are considered to have been damaged after delivery and while upon the customer’s property a return or repair or refund of the goods will not be accepted by WES. It should be noted that if an order is cancelled by the customer for any reason other than fault, a manufacturers collection charge shall be due, as detailed within the below 'cancellation' section. 

COMPLAINT

In the event of any complaint or grievance, the Customer should initially make contact by telephone on 01275 831888, or by email to mail@4wes.com stating their order reference and the nature of their complaint. All communications of this nature will receive a response outlining WES’ position and course of action within 2 working days of the issue being raised. Should action be required by WES to redeem a matter this shall be undertaken at the earliest opportunity with the assistance of the original manufacturer if deemed appropriate. It is the intention of WES to resolve any dispute fairly, amicably and to the satisfaction of the Customer at the earliest opportunity.

CANCELLATIONS

The Customer shall have a period of 7 days after the date of delivery within which time they may cancel their order for a product. Cancellations should be sent by email to mail@4wes.com or by registered post to WES’ trading address, quoting the order reference given when the order was placed. It should be noted that if the Customer decides to instigate cancellation proceedings through reason other than fault or damage as previously detailed, the Customer shall incur at cost our manufacturers collection charge. This sum shall be levied at the cost rate quoted by the manufacturer. This sum is typically around £30 to £40 for a small product, through to £100+ for larger product such as beds and baths. The customer is entitled to undertake their own return carriage at their cost if they desire, upon which a full order refund would be given assuming the product is received by WES in its original condition. WES operates a non-profit policy upon cancellations, thus only actual collection costs are met by the Customer. Where refund monies are due, less the collection charge if appropriate, these monies shall be refunded at the earliest opportunity and certainly within 30 days of the cancellation date by the original payment method.

PRIVACY

We will protect and respect customer privacy. Any personal details given to WES will NOT be passed or made available to any other company, organization or third party, except where a contact name, telephone number and address are required by our manufacturers for the efficient undertaking of a direct delivery. We will only use customer telephone and email contact details when deemed appropriate, such as when we may need to make contact to discuss an order or delivery. If you have or wish to join our email newsletter list, again, we will not pass your address to any third party. A submitted email address will be used solely to forward details of any Western Equipment Supplies Ltd news, offers or promotions that we feel may be of interest.  You can be removed from our newsletter list at any time by selecting the 'unsubscribe' function on any newsletter received. Again, to respect your privacy, we do not use any completed orders for marketing purposes, unless a direct written approach has been made to the Customer and written acceptance received.

SECURITY

For customer security of sensitive information and peace of mind, our web site operates a secure e-commerce card-based payment process. Our credit card data entry and transaction confirmation pages are held on and operated by a Thawte certified secure server provided by Secure Hosting Ltd (a UK company). The server facility operates to a 128bit level of encryption, the strongest commercial level of secure encryption currently available. All entering, transfer, storage and collection of your payment details shall be undertaken securely, always using the same 128bit level of encryption. Your payment details will never be transferred by any unsecured method, such as by email or post for example.

LAW

These terms and conditions shall be interpreted in accordance with UK Law.
